A legal mystery has emerged after a former city lawyer who was struck off the Roll of Advocates in 2006 continued representing clients in Kenyan courts for nearly two decades.
Henry Enock Nyagol Aloo is now in police custody and facing allegations of fraudulently holding himself out as an advocate despite having been struck off the Roll of Advocates following disciplinary proceedings.
Nyagol appeared before Makadara Law Courts on Tuesday, where Hon. Wandie granted him a Ksh1.5 million bond after he had spent about two months in custody.
The court imposed stringent bond conditions, including a requirement that Nyagol report to the investigating officer every last Friday of the month.
“The accused person has previously demonstrated that he is a flight risk and I will issue very tough bond terms. He is also required to appear before the investigating officer every last Friday of the month,” Hon. Wandie said.
The case reportedly began with what appeared to be an ordinary exhumation dispute before a court in Budalang’i.
However, the matter took an unexpected turn after Nyagol presented a forged will.
Investigators are now looking into allegations that he operated under the name Ario & Company Advocates despite no longer being authorised to practise law.
The case has raised questions about how Nyagol managed to continue appearing in court for years without his professional status being detected, and how he was able to represent clients despite being struck off.
The Law Society of Kenya (LSK) has reportedly written to Jogo Road Police Station, where the matter was reported, confirming that Nyagol had been struck off by a disciplinary tribunal.
Investigators are now seeking to establish how he continued practising, who may have enabled him to appear in court and whether other clients may have been affected.
Police are also urging anyone who may have complaints against the former lawyer to come forward as investigations continue.
