The Directorate of Criminal Investigations (DCI) have lost a bid to obtain a search warrant against former Cabinet Secretary Raphael Tuju, even as he claims that his children are severely traumatized following his dramatic arrest.
Tuju said his daughter was rushed to hospital overnight after witnessing him being roughed up by police.
“My children saw me being mishandled by police officers,they are traumatiized. My daughter was deeply traumatized, she had to be hospitalized.She just got back at 6AM this morning.She is under medication.Any further police break in done with the flair in which they do things will traumatize my children,” he said.
He questioned why authorities were targeting his family.
“They want court orders to be allowed to break into my house. This will traumatize my daughter . I now have to move out the children.I don’t understand what the state want to do to my children.Given the hostility manifested by a state raid at my premises at 2.30AM.I am extremely apprehensive that if they gain access into my house in my absence ,they will be able to map out my security system.I have a right to protect myself.”
Tuju also took issue with Interior CS Kipchumba Murkomen, saying wondering what he wants with his bedroom affairs.
“Since Murkomen stated that they have intelligence about my bedroom, let them produce that evidence in court.”
The DCI had moved to the Milimani Law Courts under a certificate of urgency seeking access to CCTV footage from Tuju’s Karen home.
“That this honourable Court be please to issue an order compelling the Respondent to permit No.241419 IP Francis Gitau… access… for purposes of extracting un-truncated and unedited,” the application states.
Investigators argued the footage was critical, saying: “There is urgent need… which is of great evidential value in tracing the movement of Mr Raphael Tuju.”
However, the court struck out the application, with Tuju’s lawyer Duncan Okatch accusing the DCI of “sneaking” it through while a related matter is pending in Kibera.
