Former Deputy President Rigathi Gachagua has accused senior police officers of frustrating the release of Mukurweini Member of Parliament John Kaguchia despite a High Court order directing that he be freed on a KSh 100,000 police cash bail.
In a statement shared on social media, Gachagua said the High Court had ordered Kaguchia’s immediate release upon payment of the cash bail.
However, he alleged that the Officer Commanding Station (OCS) at Kamukunji Police Station had failed to comply with the directive after allegedly acting on instructions from his superiors.
According to Gachagua, the court order had already been served on the OCS, leaving no legal basis for the continued detention of the legislator.
He cautioned the Kamukunji OCS against ignoring the court order, warning that he would personally bear the legal consequences if found in contempt of court.
“My advice to the OCS is to obey the court order, as he will be held personally liable for contempt of court. When that time comes, his seniors will be nowhere to be found when he is cited for contempt,” Gachagua stated.
The former Deputy President went on to reference the case involving the former OCS of Central Police Station, who is facing murder charges over the death of blogger Albert Ojwang.
According to Gachagua, officers who execute unlawful orders often end up facing the consequences alone after those who issued the instructions distance themselves from the matter.
“He must remember that his colleague, the OCS of Central Police Station, is still in remand prison, charged with murder after obeying unlawful orders to torture the late Albert Ojwang at Central Police Station,” he added.
