Prominent city lawyer Ahmednasir Abdullahi has weighed in on the court ruling that upheld the impeachment of former Deputy President Rigathi Gachagua, criticizing the judgment and questioning its constitutional grounding.
In a strongly worded statement shared on his X account, Ahmednasir argued that Article 25(c) of the Constitution guarantees every person the non-derogable right to a fair trial, insisting that such a right cannot be limited or ignored under any circumstances.
“Under Article 25(c) of the Constitution, the right to fair trial is a non-derogable right,” he stated.
The outspoken lawyer questioned how the court could rely on what he termed as “quasi-constitutional excuses on amorphous grounds” in declining to nullify Gachagua’s impeachment.
According to Ahmednasir, the ruling failed to satisfactorily address concerns surrounding due process and fairness during the impeachment proceedings.
“So how can the court make quasi constitutional excuses on amorphous grounds in its refusal to set aside the impeachment of Hon Rigathi Gachagua?” he posed.
He further described the judgment as legally weak and lacking a solid constitutional foundation.
“The Gachagua judgment in my humble opinion is on a shaky, shallow, soggy and sandy soil,” Ahmednasir remarked.
