“If anything bad happens to me, or I am found dead somewhere, tell them it is Sarah,” former MP Patrick Muiruri told the court today while recounting his last conversation with businessman Tob Cohen, days before his death.
The testimony emerged as the murder trial of Sarah Wairimu Kamotho, who is charged in connection with her husband’s death, resumed before Lady Justice Diana Rachel Kavedza.
The prosecution, led by Senior Deputy Director of Public Prosecutions Vincent Monda, presented three witnesses.
Mr. Muiruri, who described himself as Tob Cohen’s friend of 30 years, told the court the deceased had expressed fear for his life shortly before his death.
He recounted a December 2018 wedding at which Tob Cohen and Ms. Wairimu allegedly had a public disagreement, culminating in Sarah telling her husband, “This is not your house.”
According to Mr. Muiruri, on 15th July 2019, Tob Cohen disclosed plans to divorce Ms. Wairimu, citing alleged theft of property documents, misappropriation of company funds and prolonged marital difficulties.
Four days later, Tob Cohen reportedly called Mr. Muiruri and expressed fear about returning to his matrimonial home.
Mr. Muiruri told court Tob Cohen’s warning during that conversation was their last exchange.
Another witness, Mary Mutisya, a law firm clerk, testified that Ms. Wairimu had requested a search of land records relating to Tob Cohen’s property.
Ms. Mutisya told court Ms. Wairimu later sent her payments through M-Pesa and asked her to follow up on an application to withdraw a caveat registered against the property.
Ms. Mutisya said she later learnt from media reports that Tob Cohen was missing.
John Mungai, another witness who serves as a government analyst, produced exhibits, including clothing allegedly belonging to Cohen, a curtain recovered from inside the water tank, a red robe and a yellow polythene bag that the court heard had covered Cohen’s body when it was recovered from his compound.
The hearing continues on 14th October 2026.
