Advocate of the High Court Joshua Nyamori has weighed in on former Deputy President Rigathi Gachagua’s impeachment case, cautioning that an appeal at the Court of Appeal could potentially work against him.
Speaking during an interview on TV47, Nyamori argued that while Gachagua may choose to challenge the High Court ruling, the move could open the door for Parliament and the Senate to file a cross-appeal that may further complicate the matter.
According to the lawyer, one of the key issues likely to come under scrutiny is the medical evidence that was presented during the impeachment proceedings.
“If Gachagua appeals his impeachment judgment and Parliament and the Senate files a cross-appeal, the Court of Appeal may rule against him. His treatment papers could be deemed unreliable, leaving no evidence to support his case, and he could even lose the Sh50 million awarded,” Nyamori stated.
Nyamori suggested that if the appellate court finds inconsistencies or weaknesses in the medical documents relied upon during the case, judges could overturn parts of the High Court decision that were favorable to Gachagua.
He further noted that a cross-appeal by Parliament and the Senate would give the appellate court an opportunity to re-evaluate the entire matter, including the compensation awarded to the former Deputy President.
The Sh50 million compensation awarded in the case has already sparked mixed reactions among Kenyans, with some supporting the decision while others questioning the justification for the payout.
