Quick Mart Loses Case Against Wells Fargo After Millions of Shillings Were Stolen During Transit

Quick Mart has lost its case against Wells Fargo after seeking to recover an additional KSh14,918,750 that was part of money stolen while being transported to the bank.

The supermarket chain sued Wells Fargo after KSh94.9 million collected from its outlets was lost in transit, arguing that the security firm had breached their contract by failing to deliver the cash to the bank.

Although Wells Fargo admitted the loss, it had already paid KSh80 million in compensation and relied on a contractual clause limiting its liability to that amount.

Quick Mart argued that each cash collection should be treated as a separate transaction, which would allow it to recover the remaining balance.

However, the Court disagreed, ruling that the contract clearly capped Wells Fargo’s total liability at KSh80 million for the entire consignment, not for each individual collection.

Since that amount had already been paid, Quick Mart’s claim for the remaining KSh14.9 million was dismissed.

The Court also dismissed Wells Fargo’s counterclaim for unpaid service fees, finding that the company had failed to provide sufficient evidence to support the claim.

As a result, neither party was awarded any additional compensation, and each was ordered to bear its own legal costs.
