Law Society of Kenya (LSK) President Charles Kanjama has stated that former Deputy President Rigathi Gachagua still remains eligible to seek public office despite the recent High Court ruling that upheld his impeachment.
Speaking during an interview on Citizen TV, Kanjama argued that Gachagua’s political rights cannot be fully curtailed until all available avenues of appeal have been exhausted.
According to the LSK president, removal from office or findings related to unconstitutional conduct under Chapter Six of the Constitution only become final after the appeals process is concluded.
“When you are removed from office or when you are found liable for unconstitutional acts that violate Chapter Six of the Constitution, they will disqualify you only if your right of appeal has been exhausted,” Kanjama explained.
He emphasized that Gachagua still retains the legal right to challenge the court’s decision in higher courts.
“The right of appeal has not been exhausted,” he added.
Kanjama further argued that the High Court ruling does not entirely bar Gachagua from politics, but instead preserves his constitutional right to contest for elective office should he choose to do so.
“The decision of the High Court vindicates the right of former DP Gachagua to seek public office if he so decides to; he still can run for office,” he stated.
